Profit Ahead of Patient Care

There are currently 1.4 million people living in approximately 15,600 nursing
home facilities across the United States (according to Medicaid services).

Many corporations enter the nursing home industry to profit from an emerging area of senior care, with nearly 70% of all senior care facilities operating as for-profit businesses.

In many instances, operators trim staff to bare-bone levels to maximize
profitability.

What if You Suspect Abuse?

There could be anger, frustration, and possibly guilt when you learn that a loved one has been injured or is a victim of elder abuse or nursing home negligence at a skilled nursing facility.

What do you do?

  • Take your loved ones to a safe space so they can share what they recall regarding the incident.
  • Take notes to be recalled later and document any injuries.
  • Talk to other nursing home patients about their experiences around the
event date or, in general, about the staff.
  • Gather full names, schedules, and health records to be available when
you report to Adult Protective Services or the police.
  • Collecting and organizing this evidence will help when filing your report; it can help investigators with the abuse or neglect case.

An open wound or pressure sore can develop. When left untreated, pressure sores can result in pain, infection, and serious medical complications.

Sexual Abuse & Assault

Nursing homes have a duty to protect patients and keep them safe. Unfortunately, a sizeable number of nursing home residents are victims of sexual abuse perpetrated by staff, other residents, and visitors. When these episodes occur, the facility may be held legally accountable.

Falls

Falls are amongst the most common type of injury in nursing home residents. A fall in an elderly person can result in a fracture, brain injury, or even death. Nursing homes are required to screen each patient for their propensity to fall and apply safeguards to prevent falls.

Medication Errors

Most nursing home patients receive some type of prescription medication.  Staff in nursing facilities have a duty to administer the correct medication and dosage to each patient. When a resident receives the wrong medication or an improper dose and is injured, they may have a claim against the facility.

Malnutrition

If a nursing home resident is not given adequate nutrition or hydration, serious complications can arise resulting in diminished quality of life, hospitalization, or even death. Facilities need to keep each patient as healthy as feasible to help them maintain the highest quality of life possible.

Wrongful Death

No one deserves to be abused or neglected in a nursing home. When abuse or poor care results in the death of a resident, the family of the deceased has legal rights to file a wrongful death lawsuit against the facility to recover compensation for loss of economic and emotional support.

Orthopedic surgery was performed and after a four-week recovery at a different skilled nursing facility, the woman died.
